Definitions: For the purposes of these terms of service & conditions of sale, “Powercut”, ”Powerpools” and “Jacuzzi West Wales” are trading names of the business Powercut (Wales) Ltd., whose works address is Oaklands Mansion, Cwmffrwd, Carmarthen. “We” and “us” means Powercut (Wales) Ltd., its owners, staff and associates; “you” and “your” means the person or business ordering goods under these terms and conditions. “Manufacturer” means the makers, importers or UK distributors of any item offered.
Statement: It is a fundamental principle of our trading that we wish to ensure your complete satisfaction from your dealings with us. We will do all in our power to continually provide you with a high quality service that we will be proud of. Your agreement to purchase from us means that you also confirm that you agree to the following terms and conditions:
Suitability recommendations: Recommendations for the suitability of use of any item can only be based on the information we have been supplied with, therefore it is your responsibility to ensure that this information is complete and accurate. We are available to assist you during your decision process. However, certain items may carry recommendations for usage which you will have to take into account. We wish to assist you with help and advise as often and as much as possible and we always recommend that you contact the manufacturer for further guidance. We will help to guide you through the recommendations made by the manufacturer as seen in the operators manual. You accept full responsibility and liability for the consequences of any intended or possible use that you may make of the item if we were not made aware of that use prior to purchase.
Ordering: When ordering goods with us, you agree to be bound by these general terms and conditions and also any other item-specific terms and conditions which we may draw your attention to. You accept responsibility for ordering the correct items and quantities that you wish to receive. You agree to providing us with a non-refundable deposit at the time of order for any item which we do not hold in stock at the time of your order. This deposit will be a minimum of 10% of the retail price of the goods or any other amount which we will inform you of at the time of your order, plus any extra expenses that may be incurred. Should you wish to then cancel your order you accept and agree that you will not be entitled to any refund of your deposit. Should you place orders using manufacturer part numbers, you will need access to your own manufacturer parts lists to obtain these numbers. We may be able to supply these for you by prior arrangement. We may not accept returns based on the incorrect ordering of items if the item supplied is that which you ordered. All items must be checked upon delivery and you must contact us within 24 hours should there be any issues such as damage. Invoice, payment, title and risk: Queries or disputes regarding any invoice must be made to us within 14 days of the invoice date otherwise it shall be deemed that the content, terms and financial demand of the invoice have been accepted in full. Payment for goods ordered is due on request. Unless prior arrangements have been made in writing, all goods purchased are due for payment in full prior to leaving our premises. All goods remain the property of Powercut (Wales) Ltd. until paid for in full. You agree to allow us unfettered access to retrieve any goods supplied should these payment terms not have been met. The customer assumes all risks associated with the goods upon receipt or delivery.
Safety First: Machinery can be dangerous. You agree not to use or allow the use of any equipment or machinery we have supplied you if you are unsure of its safe operation or are unable to use it safely. We supply all wholegoods with operator manuals which will detail safe operation. You agree to abide by these recommended safety guidelines. It is an important condition of sale that the customer agrees not to attempt to use, or to allow the use of, any machine or equipment supplied by us until that customer has taken all necessary steps to become fully conversant with the safe operation of the unit. Furthermore the customer agrees not to use or allow the use of the machine without first ensuring that all safety components are functioning correctly. It is the responsibility of the customer to ensure that any goods purchased from us are only used by appropriate persons and within safe situations and that due care will be exercised to protect both themselves and others from all associated risks.
Delivery: Whilst we treat all orders as urgent we are unable to guarantee a delivery time on any goods. Actual delivery dates and times are usually notified by prior consultation at the time of sale. For wholegood items, transportation of goods to a specific location is a separate order, made by individual arrangement with the customer, following our receipt of your order and after we receive payment. For consumer sales, the handover and / or delivery point for all items sold by Powercut or Powerpools is the public entrance to Oaklands Mansion, Cwmffrwd, Carmarthen SA31 2ND (known as the “primary delivery point”). Any returns will be collected free of charge from that point. (For further details please see our Returns Policy document. ) Further onward transportation or other bespoke services are not included as a part of any sale but may be arranged or purchased by specific request. All orders and our ability to supply them are dependent upon availability, both in our stores or that of our suppliers. We do not accept liability for any costs incurred due to late, postponed or cancelled delivery, as these events may be due to reasons beyond our control.
Warranty: All items sold as new will carry the full manufacturers warranty. The length and terms of that warranty may vary from different manufacturers. A copy of our warranty policy regarding individual manufacturers is available separately, on request. Any item purchased as previously used (otherwise named “secondhand”), will be clearly marked as such in our literature and will carry a different warranty. You are advised to check with us regarding the specific warranty attached to any individual item. To obtain warranty from ourselves or any other suitable repair centre, proof of purchase would be required. The cost incurred for the transportation of any item which is eligible for warranty repairs will be free of charge between the primary delivery point and our repair centre only. The cost of any transportation between the primary delivery point and any other location is to be borne by the customer. Should any item encounter a failure that is not due to misuse or fair-wear-and-tear then the customer will allow us any reasonable unfettered access to the item for the purpose of inspection and / or repair. Please note that to obtain repairs under warranty terms, the failure must comply with any relevant warranty policy. The customer must comply with all the manufacturers terms of warranty.
Returns: Our returns policy is on display at our premises and a copy is available to you on request.
Privacy: We will need certain information from you to help us process your order and maintain our business relationship with you. For the purpose of delivery, we will need to pass some of your information to a courier or to a manufacturer or other supplier for the purposes of warranty registration etc. This may mean that you are contacted by these individuals or organisations for the purposes of marketing. We collect and hold such information securely and in accordance with the Data Protection Act 1998. You have the right to rectify the data at any time. We will not trade your information to any other party.
General: We reserve the right at any time to revise any or all prices without prior notice. All orders for products are subject to availability irrespective of information previously supplied. We reserve the right to refuse to supply any individual, company or organization for whatever reason.
Finally: We want happy, satisfied customers. We will work to maintain your trust in us. If there is a disagreement then hopefully, common sense will prevail. If not, then… These terms and conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Should legal proceedings commence then resolution is to be sought in the nearest available Court to Carmarthen.
